No, no. Sharing music isn't illegal. Downloading is, I believe. There's a difference between making the product available, and actually ripping the product off.

It's not theft. It's counterfeit. To be theft there it would have to involve the loss of a physical item, and thus, the loss of actual money. Sharing music involves making unlimited copies of an item, effectively reducing its value. An indirect loss of money.
For the record, no, I don't make it a habit to pirate music. The most I'll do is download a song to hear what people are talking about. I could accomplish the same thing by listening to the radio and recording that, or by listening to an internet radio station, it's just faster this way.
P2P is magic for indie musicians though, easy and free way to get your stuff into the market.

That's not true... identity theft is not the act of stealing someone's physical identity...
Besides theft is defined as the act or instance of stealing, which is defined as to take the property of another without their permission. So yes it is theft. But do I have feel as if I've done something terribly wrong if I download music online? No... not at all...

Sharing the file was ruled as legal. I read nothing in the article that said that downloading shared music was legal.
The judge who ruled said he saw no difference between sharing music, and having a copy-machine in a library. Thus, it's not against the law to provide the product, it's against the law to take the product.
I could be missing something though, and the fellow may have ruled that all music sharing is legal (both sharing and taking), in which case he would have just put the music industry out of business entirely.
